These Terms of Service ("Terms") govern your access to and use of the website located at https://www.mydrnow.com (the "Website"), , the SMS messaging program described in Section 8, the patient portal, telehealth services, and any other digital services operated by The Good Health Group, LLC dba MY DR NOW ("MY DR NOW," "we," "us," or "our"), collectively the "Services."
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
These Terms do not govern the clinical care relationship between you and MY DR NOW. That relationship is governed by the separate Patient Services Agreement signed at intake.
"You" or "User" means any person who accesses or uses the Services.
"Patient" means an individual who is currently or has been treated by MY DR NOW.
"Content" means all text, images, graphics, audio, video, software, and other material made available through the Services.
"PHI" means protected Health Information as defined under HIPAA.
"Patient Portal" means the Epic MyChart instance accessible through MY DR NOW at https://mydrnow.epicmychart.com, operated by Epic Systems Corporation.
You must be at least 18 years old to agree to these Terms on your own behalf. Parents or legal guardians may use the Services on behalf of minors in their care, subject to applicable Arizona law regarding minor consent for healthcare. The Services are intended for use by individuals located in the United States, and primarily by residents of Arizona.
MY DR NOW provides Family Practice, Internal Medicine, Pediatric, and Immediate Care services through in-office visits, telemedicine, and house calls. The Website provides general information about our services, allows scheduling, and links to the Patient Portal.
We reserve the right to modify, suspend, or discontinue any portion of the Services at any time without notice.
Content on the Website is provided for general informational purposes only and is not medical advice. Nothing on the Website creates a doctor-patient relationship or substitutes for professional medical consultation, diagnosis, or treatment. A doctor-patient relationship is established only through a scheduled office visit, telemedicine visit, or house call.
If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. Do not use the Website, Patient Portal, SMS messaging, or email to communicate emergency medical conditions. We do not monitor these channels in real time and cannot respond to emergencies.
You should not act or refrain from acting based on Content from the Website without seeking professional medical advice from a qualified provider familiar with your specific condition.
By using our telehealth services, you acknowledge that telemedicine involves the use of electronic communications to enable healthcare providers at different locations to share patient medical information for the purpose of improving patient care. Our providers are licensed to practice in Arizona, and telehealth visits are generally available only to patients physically located in Arizona at the time of the visit unless otherwise permitted by applicable law.
You are responsible for ensuring you have a compatible device, stable internet connection, and a private environment for your telehealth visit. We are not responsible for technology failures on your end.
Not all conditions can be appropriately diagnosed or treated via telehealth. The provider may determine that an in-person visit is necessary. Prescriptions for controlled substances may be limited or unavailable via telehealth in accordance with state and federal law.
The Patient Portal accessible at https://mydrnow.epicmychart.com is operated by Epic Systems Corporation under the MyChart product. Access to the Patient Portal is governed by Epic's terms of use and privacy notice, which are presented to you during registration with Epic. MY DR NOW does not create, host, or manage Patient Portal accounts. We receive and contribute health information through the Patient Portal in our capacity as your healthcare provider.
You are responsible for safeguarding your Patient Portal credentials and for activity conducted through your Patient Portal account. Report suspected unauthorized access to both Epic (through MyChart support) and MY DR NOW.
MY DR NOW operates an SMS messaging program ("MY DR NOW Patient Care Reminders") to send transactional and informational messages to patients and health plan members who have opted in. Message types include:
Appointment reminders
Care coordination communications
Care gap follow-ups
Preventive care outreach
You may opt in to the SMS program by submitting your mobile phone number through the MY DR NOW SMS opt-in form at https://www.mydrnow.com/sms-signup and checking the SMS consent checkbox.
At the point of opt-in, you are informed that:
You are consenting to receive recurring SMS messages related to your healthcare services
Message frequency varies, up to 6 messages per month
Message and data rates may apply
You may opt out at any time by replying STOP
You may request help by replying HELP
Consent is not a condition of receiving medical care or services
Message frequency varies based on your individual care needs and appointment activity, up to a maximum of 6 messages per month for the SMS program.
Message and data rates may apply. Charges are determined by your wireless carrier, not by MY DR NOW. Contact your carrier for details about your messaging plan.
You may opt out of SMS messages at any time by replying STOP to any message you receive. After opting out, you will receive a final confirmation message and will no longer receive SMS communications from this program. Standard carrier opt-out keywords (STOP, END, CANCEL, UNSUBSCRIBE, QUIT) are also honored.
You may alternatively opt out by emailing Remedy@MYDRNOW.com, though the STOP keyword is the fastest method.
For help with the SMS program, reply HELP to any message, or contact us at (480) 677-8282. Standard message and data rates apply to HELP replies.
The SMS program is compatible with major U.S. wireless carriers, including but not limited to AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Cricket, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.
We won't share your information with third parties.
Your mobile phone number, opt-in records, and SMS-related data are handled in accordance with our Privacy Policy at https://www.mydrnow.com/privacy-policy. Mobile phone numbers, SMS opt-in data, and consent records collected through this program will not be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent records will not be shared with any third parties under any circumstances. This information is not sold.
Mobile information is processed only by service providers necessary to deliver the SMS messages you have requested, such as the telecommunications carrier transmitting the message, and only to the extent necessary to deliver those messages.
We minimize the inclusion of Protected Health Information in SMS messages. SMS is not a fully secure communication channel. By opting in, you acknowledge the inherent risks of SMS communication and consent to receive messages that may include limited health-related information necessary to fulfill the purpose of the message.
By consenting to receive text messages from MY DR NOW, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP to any message.
By providing your email address to MY DR NOW, you consent to receive email communications related to your healthcare services. You may opt out of non-essential email communications at any time using the unsubscribe link or by emailing Remedy@MYDRNOW.com. Certain transactional emails (appointment confirmations, billing notices, security alerts) may continue regardless of opt-out status, consistent with applicable law.
You agree not to:
Use the Services for any unlawful purpose
Attempt to gain unauthorized access to any portion of the Services, including the Patient Portal
Interfere with or disrupt the Services or servers
Use any automated means (bots, scrapers, crawlers) to access the Services without our prior written permission
Upload or transmit viruses, malware, or other harmful code
Impersonate any person or misrepresent your affiliation with any entity
Use the Services to harass, abuse, or harm another person
Reverse engineer, decompile, or disassemble any portion of the Services
Use the Services in a manner that could damage, disable, overburden, or impair the Services
All Content on the Website, including text, graphics, logos, images, and software, is owned by or licensed to MY DR NOW and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes consistent with these Terms.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Content without our prior written permission.
"MY DR NOW" and associated logos are trademarks of The Good Health Group, LLC. You may not use these marks without our prior written permission.
The Website may contain links to third-party websites and services, including the Epic MyChart Patient Portal and our health information exchange partner Health Current. We are not responsible for the content, privacy practices, or operations of third-party sites. Your use of third-party services is governed by their own terms.
Your use of the Services is also governed by our Privacy Policy at https://www.mydrnow.com/privacy-policy, which is incorporated into these Terms by reference. PHI is additionally governed by our Notice of Privacy Practices at https://www.mydrnow.com/notice-of-privacy-practices, available upon request and at our clinical locations.
MY DR NOW is committed to making the Website accessible to individuals with disabilities. We strive to follow Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier, please contact us at Remedy@MYDRNOW.com so we can address it.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
We do not guarantee that the Services will be uninterrupted, secure, or error-free. We do not warrant that any defects will be corrected.
We make no warranty regarding any health outcome resulting from your use of the Services or your interactions with MY DR NOW.
To the fullest extent permitted by law, MY DR NOW, its affiliates, and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.
This section does not limit liability for damages that cannot be lawfully limited, including liability for gross negligence, willful misconduct, or fraud, and does not limit liability arising from the provision of professional medical services, which is governed by applicable state and federal law.
You agree to indemnify, defend, and hold harmless MY DR NOW and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any law or the rights of any third party.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, the provisions of these Terms that by their nature should survive will survive, including Sections 11, 13, 15, 16, 17, 19, 20, 21, and 22.
We may modify these Terms at any time by posting a revised version on the Website. The "Last Updated" date will be revised accordingly. Material changes will be communicated through a prominent notice on the Website or, where required by law, through direct notice to you. Your continued use of the Services after modifications constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
Before filing a formal claim, you agree to first contact us at Remedy@MYDRNOW.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days of receipt of your notice.
This Section 21 does not apply to (a) claims regarding the quality of medical care, which are governed by Arizona medical malpractice law and applicable Patient Services Agreement provisions; or (b) any claim that may be brought in small claims court.
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and MY DR NOW regarding the Services.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms at any time without notice.
These Terms do not create any third-party beneficiary rights.
